Because EB-5 investments are securities, they are regulated by the U.S. Securities and Exchange Commission (SEC). As a result, EB-5 investors must be accredited, which means they must fulfill certain net worth requirements: (i) the investor must have a net worth of $1 million, or (ii) the investor must have earned $200,000 (or $300,000 in joint marital income) in each of the past two years and expect to earn at least the same level of income in the current year.
