Can a foreign business owned by a potential EB-5 investor somehow qualify for a direct EB-5 investment?

No, a foreign business cannot qualify as a new commercial enterprise (NCE) under the EB-5 Program; the NCE must be a U.S. business. That said, funds earned through a foreign business could be used as an investment. Alternatively, if the business is owned by the investor, its assets may be able to be used as collateral for a loan that could fund an EB-5 investment.
