EB-5 Targeted Employment Area State Agencies

On November 21, 2019, the EB-5 Immigrant Investor Program Modernization Rule came into effect. Under the new rules, the Department of Homeland Security rather than individual state agencies became responsible for targeted employment area (TEA) designation. However, a June 2021 ruling in the Northern District of California overturned the Modernization Rule, reversing the changes and shifting responsibility for TEA designation back to state agencies.

State Agencies Designated to Certify EB-5 Targeted Employment Areas

Although a project location may meet the criteria for TEA designation, it is up to the discretion of each state agency to determine official TEA eligibility. Below is a consolidated list of each approved state or local agency we work with to write official TEA certification letters.

Some states are more flexible than others when it comes to combining census tracts to meet the required TEA unemployment rate. To increase the likelihood of a state agency of approving a TEA letter, we recommend providing a short analysis demonstrating how the proposed EB-5 project will impact the local economy and the local employment impact the EB-5 project will have.

When the EB-5 Modernization Rule was implemented in 2019, all state agencies stopped issuing TEA letters. After the rule was overturned in June 2021, state agencies are in the process of starting to issue letters again. Because agencies are still responding to the overturning of the rule, some of the information on this list may not be accurate.
