The most likely way for an EB-5 investor to move to the U.S. prior to receiving the EB-5 Visa is to obtain a visa that carries dual intent, such as an H-1B, L-1, or E-2 Visa. Nonimmigrant visas, such as B-1/B-2 and F-1 Visas, are not likely to be approved or renewed once an I-526 Petition has been filed.
