While thousands of foreign nationals have successfully gained permanent resident status through the EB-5 Program, this program is not for everyone. An attorney might advise against pursuing an EB-5 Visa if other immigrant visa options are better suited to the client or if he/she foresees challenges to a successful petition, such as an inability to prove lawful source and path of funds. It is also possible, however, that an attorney advises against EB-5 simply out of ignorance—the EB-5 process requires specific knowledge of a fairly complicated area of law.
