An EB-5 investor considering a project should retain an immigrant attorney to perform due diligence on the project from an immigration perspective. The investor should also retain an investment advisor to perform due diligence on the project from a business and investment perspective. The track records of the regional center and the developer are also important, as is the structure of the capital stack (i.e., the percentages of developer equity, loaned funds, EB-5 investor capital, etc.).
