Technically, the EB-5 Program allows investors to live anywhere in the U.S. The program does, however, require that investors be actively involved in managing the enterprise, either through day-to-day operations or through policy formation. For regional center investments in which the EB-5 investor is a limited partner, living near the project generally has no bearing on an investor’s ability to take part in policy formation. For direct investments in which the investor must manage the daily operations of the enterprise, it may be impractical to live far from the project.
