Because filing Form I-526 does not grant immigration status, a direct EB-5 investor may have difficulty operating the new commercial enterprise unless he/she has or can obtain employment authorization. Alternatively, the investor may hire or partner with someone in the U.S. to manage the business, at least temporarily. Due to the complexities of the EB-5 Program, particularly for direct investors, anyone considering such an investment should retain experienced EB-5 immigration counsel in order to work out the details before investing.
