If a regional center loses its designation with USCIS, the consequences for investors will likely be severe. Pending I-526 Petitions will not be approvable. Investors with approved I-526 Petitions will likely have to file new I-526 Petitions based on new EB-5 projects. For investors with pending I-829 Petitions, however, it may be possible to receive approval if the necessary jobs were already created through project expenditures. Any EB-5 investor with a pending I-829 Petition who invested through a regional center that lost designation should consult an experienced EB-5 immigration attorney to determine what options may be available.
