An immigration attorney can also perform due diligence related to the immigration risk of a project, examining how likely an EB-5 investment will be met with approval by USCIS each step of the way. Except as they relate directly to immigration and EB-5 compliance, an immigration attorney should not be advising on the investment itself or the financial and business considerations of the investment; separate securities counsel and a financial adviser should be retained to assist in these areas.
