Generally speaking, if an I-526 Petition is fully compliant with EB-5 laws and regulations, USCIS will approve it. An increase in denials in a given year is most likely due to a higher number of noncompliant petitions being adjudicated. Due to the complex nature of the EB-5 Program, petitions may be denied for any number of reasons.
