If an EB-5 investor anticipates his/her nonimmigrant visa will expire before I-526 adjudication, the options are limited. There is no way to expedite a decision on an I-526 Petition, and so the investor may either seek an extension of his/her current visa, apply for a different nonimmigrant status, or return to his/her home country and consular process.
