When does an EB-5 investor become subject to U.S. taxes and other laws?

Whenever a foreign national is in the United States, he/she is subject to all local, state, and federal laws. An EB-5 investor’s U.S. tax obligation generally begins when he/she obtains conditional permanent resident status and is physically residing in the United States—though investors residing in the U.S. under a nonimmigrant status may already be subject to U.S. taxes.
