An EB-5 investor’s attorney being disbarred will not necessarily have an impact on a pending I-526 Petition.If, however, the attorney was negligent in preparing or filing the I-526 Petition,this could result in an RFE or denial. Also, the reason for disbarment might cause USCIS to more carefully scrutinize the petition. The best course of action would be to retain new counsel and have that attorney file a notice of appearance as the new attorney of record.The new attorney should also review the submitted I-526 Petition to ensure it was complete and accurate.
