Civil court cases do not generally have a bearing on one’s eligibility for permanent resident status. Depending on the nature of the SEC lawsuit, however, USCIS may be concerned about whether the suit affects lawful source of funds and may issue an RFE. Because of how the previous lawsuit could affect an EB-5 case, it would be best to retain an experienced EB-5 immigration attorney before proceeding.
