If a regional center loses its designation with USCIS, the consequences for investors will likely be severe. Pending I-526 Petitions will not be approvable. Investors with approved I-526 Petitions will likely have to file new I-526 Petitions based on new EB-5 projects. For investors with pending I-829 Petitions, however, it may be possible to receive approval if the necessary jobs were already created through project expenditures.
