What are the consequences to an EB-5 investor if the regional center closes?

The consequences of a regional center closing—whether due to bankruptcy, termination of USCIS designation, or some other cause—will depend somewhat on the timing of the closure relative to the investor’s EB-5 case. If the I-526 Petition is not yet adjudicated, it is likely to be denied. If the I-526 is approved, it could be very difficult to obtain I-829 Petition approval. If, however, it can be demonstrated that the necessary number of jobs have been created at the time the I-829 is filed , the investor may be able to obtain I-829 approval.
