Can an EB-5 investor’s current business invest in a new commercial enterprise (NCE) on his/her behalf?

No, the funds used in an EB-5 investment must be the personal funds of the investor. A business’s funds cannot be used as the source of an EB-5 investment, even if that business is owned by the investor. Funds from the business may, however, be paid out as salary or a distribution to the investor, or the business may loan the funds to the investor in the form of a member or shareholder loan.
