How long must job positions exist to be considered “permanent” and count toward EB-5 employment creation?

Generally speaking, in order for a job position to be counted toward EB-5 employment creation, the job must exist at the time the I-829 Petition is filed—or must be expected to exist within a “reasonable period” thereafter. While the EB-5 Program requires jobs to be “permanent,” this doesn’t mean they must exist indefinitely—the requirement is that the jobs are not temporary or seasonal in nature.
