While a person can pursue both the EB-2 and EB-5 immigrant visa paths, when submitting Form I-485, he/she can file under only one employment-based category. When choosing which category might be best, timing is one consideration since, depending on the circumstances, one path may be quicker than the other. Another significant consideration is that permanent resident status through EB-5 is conditional for two years while the status granted through EB-2 is not.
