Any for-profit enterprise engaged in lawful business activities can qualify for an EB-5 investment. The business must be classified as a new commercial enterprise (NCE), which generally means it must have been established after November 29, 1990. In order to work for EB-5, the business must also be able to generate 10 or more full-time, permanent job positions.
