Can an F-1 Visa holder extend F-1 status with a pending I-526 Petition?

It is possible to extend F-1 status with a pending I-526 Petition as long as a student asks his/her designated school official (DSO) for an extension before the program end date listed on his/her Form I-20. If granted an extension, the student will be able to remain in the U.S. on F-1 status until the new program end date. If, however, the student fails to ask for an extension before the program end date, the only options for keeping F-1 status are (i) to request reinstatement through Form I-539, which requires disclosure of any immigrant petitions, or (ii) to leave the country and reapply for the F-1 Visa, which would also require disclosure of immigrant intent. Since the F-1 Visa does not allow for immigrant intent, a pending EB-5 petition will make reinstatement or reentry on an F-1 Visa difficult.
